Terms of Service
Effective date: November 1, 2026
These Terms cover SumpPumpReplacementElgin.com and its referral line for sump pump work in Elgin, Illinois. Any repair or replacement is arranged directly with the independent plumber you reach, under that plumber's own estimate, agreement and terms.
1. Acceptance and Scope
These Terms of Service ("Terms") are an agreement between you and SumpPumpReplacementElgin.com ("this site," "we," or "us"). They apply to sumppumpreplacementelgin.com, its referral phone line, the call connections it makes, and related emails (together, the "Services").
Using this site or its phone line means you accept these Terms and the Privacy Policy. If you do not accept them, do not use the Services. You must be at least 18 and able to enter a binding agreement. If you call for a landlord, property manager, business, association or another owner, you confirm that you have authority to arrange a plumber contact for that property.
2. Sump Pump Information and Referral Calls
The Website offers general sump pump information and a phone line that connects Elgin callers with independent local plumbers. This site is not a plumber and does no work. Calling the line or emailing the site does not create a service contract, promise that a plumber is available, book an appointment, set a price, or ensure that a problem can be diagnosed or fixed.
Availability, scope, scheduling, access to the basement, pricing, warranties, permits, payment terms and any other service obligations are set between you and the plumber you are connected with, through that plumber's estimate, work order or direct conversation. The plumber is an independent business, not an employee or agent of this site, and remains your point of contact for any sump pump repair or replacement you agree to.
You agree to give accurate contact, address, access and problem details and to correct them if they change. If you are not the owner, you are responsible for getting permission from the owner, landlord, tenant or occupant before asking a plumber to come out or sharing their details.
3. Safety and Emergency Limitations
The Website is not an emergency dispatch service and should not be relied on for real-time safety instructions. If water in a basement is near outlets, appliances or an electrical panel, if sewage is present, if you smell gas, or if flooding or structural damage threatens anyone, leave the area when appropriate and call 911, the fire department, the utility, or building management.
General sump pump information on the Website does not replace an on-site look by a qualified plumber. Do not step into standing water near live power, handle a pump with wet hands, open a sealed pit lid, or take on work beyond your training based only on Website content.
4. Privacy and Electronic Communications
This site's Privacy Policy explains how information is collected, used, shared, kept and protected. By calling the referral line or emailing the site, you allow the site and the plumber who takes your call to contact you about that sump pump problem by phone, email or another method you chose. That permission does not extend to unrelated marketing.
You are responsible for phone carrier, internet and device charges. Calls and emails can be delayed, filtered, intercepted or misdirected, so do not send highly sensitive information by email or voicemail.
5. Acceptable Use
You may use the Services only for lawful purposes. You must not:
- Give false, fraudulent, harassing, defamatory or unlawful information, or pretend to be someone else.
- Make prank or automated calls, send spam, malicious code or floods of traffic.
- Probe, scan, bypass or disable the site's security, access controls or rate limits.
- Reach data or systems without permission, or disrupt the Services, the call-tracking network, other users or third parties.
- Scrape, copy, frame, republish or commercially exploit the Services unless the law or written permission allows it.
- Use the Services to put people at risk, invade privacy, infringe intellectual property, or help with illegal conduct.
6. Website Content, Intellectual Property, and Your Messages
The Services, name, design, text, graphics, photographs, code and other materials belong to the site or its licensors and are protected by intellectual-property laws. You may view and use Website content for personal, rental-property or business purposes connected with understanding a sump pump problem or reaching a plumber. All rights not expressly granted are reserved.
You keep ownership of what you say on a call or write in an email. You give the site a non-exclusive, worldwide, royalty-free license to store, copy, transmit and use it only as reasonably needed to run the Services, connect your call, answer you, keep records, protect the Services and follow the law. You confirm you have the right to share it.
If you send ideas or feedback without a separate confidentiality agreement, the site may use them freely and without payment, while any personal information in them stays under the Privacy Policy.
7. Third-Party Services and Links
The Services rely on or link to hosting, call-tracking, telephone, mapping, font and other technical providers. The site does not control their availability, content, security, terms, privacy practices or decisions, and a link or integration is not necessarily an endorsement.
Those services, and the independent plumbers reached through the line, operate under their own terms and policies. To the fullest extent the law allows, this site is not responsible for their acts, omissions, estimates, work, products, statements or data practices.
8. Disclaimers
To the fullest extent the law allows, the Services are provided "as is" and "as available." The site disclaims warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, uninterrupted availability, error-free operation, compatibility and security. It does not warrant that Website information is complete or current, or that a call will reach a plumber within any particular time.
Every basement, pit and pump is different. Photos, descriptions, maintenance tips and examples are illustrations only, not a diagnosis, estimate, code determination, warranty or statement about any specific property.
Some places do not allow certain warranty exclusions. Where that is so, these exclusions apply only as far as the law permits.
9. Limitation of Liability and Indemnification
To the fullest extent the law allows, SumpPumpReplacementElgin.com and its owners, affiliates, personnel, licensors and service providers are not liable for indirect, incidental, special, exemplary, punitive or consequential damages, lost profits, lost data, business interruption, lost goodwill, water damage, property damage or personal injury arising from use of or inability to use the Website or referral line, reliance on general Website content, work done by an independent plumber, a third-party technical service, or unauthorized access, even if told such harm was possible.
To the fullest extent the law allows, the site's liability for claims arising only from use of the Website or referral line is limited to the direct damages you prove. This does not change liability that cannot be limited or any separate agreement you make with a plumber.
You agree to defend, indemnify and hold the protected parties harmless from third-party claims and reasonable costs arising from your unlawful use, a breach of these Terms, infringement of someone else's rights, or sharing information you had no authority to share. This duty does not apply to the extent a claim results from the site's own unlawful conduct.
10. Suspension, Termination, and Discontinuation
The site may suspend or end access to the Website or referral line when reasonably needed to address a violation, security risk, legal requirement, abuse such as prank calls, or an operational problem. You may stop using the Services at any time. Terms that by nature should survive, including ownership, disclaimers, liability limits, indemnification and dispute terms, will survive.
The site may change or discontinue all or part of the Website or the referral line.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules, except where federal law or mandatory consumer protection law applies. Before bringing a claim, you agree to contact the site and try in good faith to settle the dispute informally for at least 30 days.
Unless applicable law requires otherwise, claims about these Terms or the Services must be filed in the state courts of Kane County, Illinois, or the federal court whose district includes Kane County, and each party consents to personal jurisdiction there. Nothing here stops either party from seeking emergency injunctive relief or using an eligible small-claims process.
12. General Terms
Changes
These Terms may be revised. A revised version takes effect when posted unless it states a later date. Using the Services after that effective date means you accept the revised Terms.
Severability and waiver
If any provision cannot be enforced, it will be adjusted only as much as needed and the rest of these Terms stay in force. Not enforcing a provision does not waive it.
Assignment and entire agreement
You may not transfer these Terms without the site's written consent. The site may transfer them as part of a reorganization, financing, merger, sale or transfer of the Services. These Terms and the Privacy Policy are the whole agreement about the Website, but do not replace an agreement you make with a plumber for sump pump work.
Interpretation
Headings are for convenience only. "Including" means "including without limitation." Electronic acceptance and records carry the same weight as paper records where the law permits.
